Terms of Service
Welcome to Levion Car Rental ("Levion", "we", "our", or "us"). We provide quality pre-owned vehicles to drivers in Ottawa and the surrounding area, with delivery to your door and a real person on the other end of the phone. These Terms of Service ("Terms") govern your use of our website at levioncar.com and the rental of vehicles from us. Together with any rental agreement you sign at pickup, they form a binding contract between you and us.
Please read these Terms carefully. By making a reservation, signing a rental agreement, or otherwise using our services, you agree to be bound by them. If you do not agree, please do not use our services.
1. Who Can Rent From Us
To rent a vehicle from Levion, you must:
- Be at least 21 years of age (some vehicles may have higher age requirements)
- Hold a valid, unexpired driver's licence recognized in Canada
- Have a licence that is not suspended, revoked, or restricted
- Provide a valid credit or debit card in your name for payment and deposit
- Provide the information we reasonably request to verify your identity
- Not appear on our do-not-rent list
Additional drivers must meet the same requirements and be listed on the rental agreement before they drive the vehicle. We reserve the right to decline a rental where we reasonably believe the requirements above are not met.
2. Reservations
A reservation is a request to rent a specific vehicle class on specific dates. Reservations are confirmed once you receive written confirmation from us by email or SMS. We will do our best to provide the exact vehicle you selected, but if it is unavailable at pickup, we will offer a comparable vehicle at no additional cost.
If we discover a pricing or availability error, we may correct it, contact you, or cancel the affected reservation. If we cancel a reservation because of an error on our side, any amounts you have paid will be refunded in full.
3. Payments and Deposits
Rental charges include the daily or weekly rate, any add-ons you select, applicable taxes (including HST), and any fees clearly disclosed at booking. You authorize us to charge the payment method on file for:
- The rental charges and any pre-authorized deposit
- Charges for damage, loss, or excess wear beyond normal use
- Fuel or cleaning fees if the vehicle is not returned in the condition required (see Section 8)
- Tolls, parking violations, and traffic fines from your rental period, plus a reasonable administrative fee
- Late return fees or unauthorized extension charges
- Recovery or towing costs where we are entitled to recover the vehicle
- Any other amounts you owe under these Terms or the rental agreement
A security deposit or pre-authorization hold may be placed on your card at the time of rental and released when the vehicle is returned in acceptable condition, less any applicable charges. Release times depend on your card issuer.
4. Cancellations and Refunds
Cancellations made at least 48 hours before your scheduled pickup are eligible for a full refund. Cancellations made within 48 hours of pickup may be subject to a cancellation fee, up to one day's rental rate. If you do not arrive for your pickup or delivery and do not contact us, the reservation is treated as a no-show and is generally non-refundable.
Where a refund is due, it will be processed back to your original payment method within a reasonable time, subject to your card issuer's processing times.
5. Using the Vehicle
The vehicle may only be driven by you and any additional drivers listed on the rental agreement. You agree to drive responsibly, follow the Highway Traffic Act and all other applicable laws, and return the vehicle in the condition you received it, aside from ordinary use.
The following are not permitted during a rental:
- Driving while impaired by alcohol, cannabis, drugs, or any other substance
- Reckless, negligent, or aggressive driving, racing, or any form of competitive driving
- Using the vehicle for any illegal purpose
- Smoking, vaping, or using any tobacco or cannabis product inside the vehicle
- Carrying pets without prior authorization
- Off-road driving or driving on surfaces the vehicle is not designed for
- Towing, pushing, or pulling any trailer, vehicle, or heavy object without our prior written authorization
- Letting anyone not listed on the rental agreement drive the vehicle
- Subletting or transferring the rental to another person
- Using the vehicle for rideshare or delivery services (Uber, Lyft, food delivery, and so on) unless we have agreed in writing
- Carrying hazardous, flammable, or illegal materials
- Taking the vehicle outside of Canada without our prior written approval
If any of these terms are broken, we may end the rental immediately, recover the vehicle, and hold you responsible for any resulting costs.
6. GPS and Telematics
Please note: some or all of our vehicles are fitted with GPS or telematics devices. By renting from us, you acknowledge this and agree to the terms below.
Where fitted, these devices may record location, mileage, and trip data during the rental period. We use this information for vehicle recovery, mileage verification, fraud prevention, incident investigation, and to support lawful requests from authorities. 7. Vehicle Return and Late Returns
Please return the vehicle to the location, on the date, and at the time shown on the rental agreement. If you need extra time, contact us as early as possible so we can arrange an extension. Extensions are subject to availability and additional charges.
If the vehicle is not returned as agreed and we cannot reach you, we may treat the vehicle as overdue, apply late fees, and take reasonable steps to recover it. In extreme cases, an unreturned vehicle may be reported to law enforcement.
8. Fuel and Cleaning
Please return the vehicle with the fuel level shown at pickup. If it is returned with less fuel, a refueling charge covering the missing fuel plus a reasonable service fee will apply. Please also return the vehicle in a reasonably clean condition. Excessive cleaning needs (stains, spills, smoke smell, pet hair, and similar) may result in a cleaning fee based on the actual cost of restoration.
9. Damage, Loss, and Insurance
You are responsible for the vehicle while it is in your care, from pickup to return. If the vehicle is damaged, lost, or stolen during the rental, you may be responsible for repair or replacement costs, loss-of-use charges while the vehicle is out of service, and reasonable administrative and appraisal fees.
Where optional protection products are offered at the time of rental, we will explain what they cover and what they exclude before you decide. These are not insurance policies and do not cover every situation. Your own auto insurance or credit card may provide coverage for rental vehicles. Please check with your provider before you rent.
Any optional protection product will not apply, and you will remain fully responsible, if the loss or damage happened because a term of the rental agreement was broken. For example, if the driver was not authorized, the vehicle was used illegally, or any of the prohibited uses in Section 5 occurred.
10. Accidents and Incidents
If you are involved in an accident or the vehicle is damaged, please:
- Make sure everyone is safe and call 911 if anyone is injured
- Contact the police as required and get a report reference
- Exchange information with any other party involved
- Take photos of the scene, the vehicles, and any damage
- Contact us as soon as reasonably possible at 613-222-5384
Please do not admit fault at the scene or agree to repairs on your own. We will guide you through the next steps.
11. Traffic Fines, Tolls, and the 407 ETR
You are responsible for any traffic fines, parking tickets, red-light or speed camera fines, and toll charges (including the 407 ETR and other Ontario toll routes) that arise during your rental. If we receive one of these on your behalf, we may pay it and then charge you the amount plus a reasonable administrative fee, or provide your details to the issuing authority as required by law.
12. Our Right to End a Rental
We may end a rental early if:
- A payment fails and is not resolved after reasonable notice
- The vehicle is being used in a way that breaks these Terms or the rental agreement
- We reasonably believe the vehicle is at risk of loss, theft, or serious damage
- You provided false information when renting
- You use the vehicle illegally or in a way that puts others at risk
Where we end a rental early, we will make reasonable efforts to contact you and give you a chance to return the vehicle. Recovery costs may be added to your account.
13. Our Website
Our website is provided as-is. We do our best to keep it available, accurate, and secure, but we do not promise it will always be uninterrupted or error-free. Prices, availability, and vehicle information shown on the site may be corrected if we discover an error, and reservations are only confirmed once we send you written confirmation.
14. Limitation of Liability
To the extent permitted by law, our total responsibility to you for any claim connected to your rental or these Terms is limited to the total amount you paid for that rental. We are not responsible for indirect, incidental, or consequential losses (such as lost profits, missed connections, or loss of enjoyment).
Nothing in these Terms limits any rights or remedies you have under Ontario's Consumer Protection Act, 2002 or other laws that cannot be excluded or restricted by contract. If any provision here conflicts with a right you have under those laws, that right applies.
15. Your Responsibilities to Us
You agree to reimburse us for costs, losses, fines, and reasonable legal fees that arise because of:
- Your breach of these Terms or the rental agreement
- Damage or loss to the vehicle caused by you or someone driving it with your permission (whether authorized under the agreement or not)
- Traffic offences or other legal violations during your rental
- Claims made against us by another person arising from your use of the vehicle
This does not apply to costs or losses caused by our own negligence or wrongdoing.
16. Communications
By providing your phone number and email, you agree that we may contact you about your reservation and rental through email, phone calls, and SMS. This includes confirmations, delivery updates, reminders, and any changes related to your rental. Marketing communications require your separate consent under Canada's Anti-Spam Legislation (CASL) and can be stopped at any time. Standard message and data rates may apply.
17. Privacy
Your personal information is handled according to our Privacy Policy, which forms part of these Terms.
18. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Effective Date" above. Changes apply to reservations and rentals made after the update. For rentals already in progress, the version of the Terms in effect at the time of booking continues to apply until the vehicle is returned.
19. Governing Law and Disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in Ontario. Any dispute that cannot be resolved directly with us can be brought before the courts of Ontario, subject to any consumer protection rights that give you access to the courts or agencies in the place where you live.
Before starting a formal dispute, please contact us first. A real person will get back to you, and we will do our best to resolve the issue.
20. General
If any part of these Terms is found to be invalid or unenforceable, the rest continues to apply. Our failure to enforce a right at any time is not a waiver of that right. These Terms, together with any rental agreement you sign and our Privacy Policy, are the whole agreement between us about your use of our services.
